Location and Data Privacy
We call upon the Texas Legislature to protect citizens' current and historic technologically available location data by requiring a warrant based on probable cause for governments to request access, except in the case of an immediate, life-threatening situation. We also call on the Texas Legislature to restrict warrantless electronic data collection and to require appropriate policies regarding the disclosure of data collection when no criminal case is filed, along with rules for retention, security, and sale of location data. We strongly oppose “contact tracing” as is suggested in Governor Abbott’s April 27, 2020 Report to Open Texas Plan, and we also strongly oppose the pending federal TRACE Act. No government entity, including the Texas National Guard, should ever be employed to violate the natural rights of Texans.
